Terms and Conditions of Use/ Service Agreement & Privacy Policy

Nutritionally Sound, LLC™ DBA: Harmony With Food™ known from this point forward as "Owner and Operator.” You ( subscriber) are agreeing to the terms and conditions set forth by the Owner and Operator of this site. The “Service” refers to the Website and all information, products, and services offered on or through the Website: Harmonywithfood™.com. The terms “we”, “us” and “our” refers to what the owner and operator of Nutritionally Sound, LLC : DBA: Harmonywithfood™ program. The terms: “you”, “your”, “yourself” and “user” each refers to the individual who uses the service. You “use” the service each time you enter the Website, navigate within the Website, download from the Website, or purchase any products or services through the Website. The term “User Content” refers to any messages, text, profiles (including your name, image, and likeness), information, photos, video, audio, artwork, and other content that you post in any group such as but not limited to a FaceBook Group. The term “post” means to upload, publish or display User Content on or through the Service or to transmit to or share User Content with other users via social media sources or mail, email, etc. Agreement Your use of the service is subject to these Terms and Conditions, as well as to our Privacy Policy (see below). These Terms and Conditions and the Privacy Policy together constitute a legally binding agreement (the “Agreement”) between Nutritionally Sound, LLC™, DBA: Harmonywithfood™and you. When you first use the Service, and again each time you use the Service thereafter, you are confirming that you are bound by the Agreement. If you do not wish to be bound by the Agreement, you may discontinue using the Website and the Service. You may also “unsubscribe” from any newsletter or blogs or any other items at any time.

Eligibility

You must be eighteen (18) years of age or older to view, participate, or purchase any product or service offered on or through the Website.

Health Information

The information presented on the Website is in no way intended as medical advice or as a substitute for medical treatment. This information should only be used in conjunction with the guidance and care of your physician.
The Service is intended to provide you with information and tools to help you look and feel better. You should consult your physician before beginning any diet, nutrition, or fitness program through the Website.

In particular:

You may not participate in Harmony With Food™ (Nutritionally Sound, LLC™.) program if you are a nursing mother or an individual with food allergies, sensitivities, and or intolerances of any kind. The current programs are not devised for individuals who have special food sensitivities or special dietary needs such as (i.e.: celiac disease, Crohn's disease, Irritable Bowel Disease, etc). Nor is this program designed for Vegans, Vegetarian, or any special religious requirements you may abide too. In the near future, these programs may become available. However, at this time the information offered is for general information and entertainment purposes only. This is in no way to be used for or substituted for Medical information obtained from your Physician or MD. This information is only for the person without any strict dietary needs. If you are an individual living with diabetes or heart disease, you may participate in our program only with the express consent of your physician. The meals/recipes are adherents to the Guidelines suggested by the American Diabetic Assoc, The American Heart Association, and The Academy of Nutrition and Dietetics.

Annual Members: The 6-week Plan for annual membership does not include Breakfast or Lunch. The rationale of the program is that most people do not have problems with breakfast and lunch. When a person arrives home hungry tired and ill-prepared for dinner. Then most people will make the easy, unhealthy choice vs. the healthy choice. If you have any nutrition-related disease, you may participate in the program only with the consent of your Physician/ Medical Doctor.

This is not a guarantee of any kind that you will lose weight.

You understand that this plan is not individualized for you, this is a generic suggestion not specifically tailored to your health care needs.

You understand that this free program will be available to you, until or if the website is redesigned or discontinued.

If we are having technical difficulties with the website. You may not be able to access the information from the site, until the issue is resolved.

You understand that if you join any group of ours, we may make suggestions or have “tips of the day” via video, blog, email, or newsletter. However, you fully understand that Nutritionally Sound™, LLC has no obligation to answer random questions that arise as the number of emails are or may be at such a high capacity that Nutritionally Sound™, LLC. We will not be able to answer each individual question that may arise. You are joining this program fully aware that Nutritionally Sound LLC™ has no obligation to answer a specific question that you may have. Annual members will receive what is promised on the website. However, if a member makes an appointment for skype or phone or email and that person is not there at the scheduled time. That appointment is considered a “No Call No Show” and the time scheduled with you is will be charged. Nutritionally Sound,LLC™ has a strict 48 hours notice policy for cancelation of any appointments. If you do not give at least 48 hours notice your appointment time will not be reimbursed in any manner.

Nutritionally Sound, LLC™. will be making recommendations, sending tips of the day, video blogs and emails etc. on a random basis. This program in no way promises to develop an individualized program for your specific needs. It is your responsibility to discuss your continued participation in our program with your physician.

This is in no way, shape, or form medical advice.

Nutritionally Sound, LLC. “Harmonywithfood™” program may contain food suggestions that have been manufactured in a facility that also processes: milk, eggs, peanuts, tree nuts, wheat, soybeans, or fish, including shellfish. If you have any food sensitivities, allergies or intolerances this program may not be utilized.

It is not Nutritionally Sound’s LLC™’s duty to provide specific diet sfor specific needs for individuals. At this time,

This program is for individuals who wish to eat healthier or lose weight. You must contact and request permission from your Physician if you wish to join any of the groups.

You are responsible for proper heating and food handling. Foods must be cooked to proper temperatures or you are at risk for a serious foodborne illness. Nutritionally Sound, LLC™ is not responsible for consumption of food undercooked or Ill-prepared.

Cross-contamination of food can lead to food allergy issues, food born illnesses, etc. All foods must be cooked to correct temperatures. Foods should not be consumed in the danger zone. Hot foods must remain at correct temperatures and cold foods need to be kept at appropriately cold temperatures.

Ordering, Billing, and Fulfillment

When you register for a certain online program with Harmony With Food ™, your credit card will be charged for the amount listed on www.harmonywithfood.com website. Valid credit card, which will be billed at the time of the purchase.

We offer no refunds once purchased, However, you do have 72hrs after signing contract to terminate contract and be reimbursed.

License and Website Access

Provided you are eligible to use the Service, we grant you a limited license to access and use the Website for your personal non-commercial use. Any other use of the Service or the Website without our prior written permission is strictly prohibited and will terminate your limited license. Without limiting the generality of the foregoing,

except for your own Use. Content, you may not upload or republish Website content or incorporate the information in any other database or compilation; you may not use any data mining, crawling, robots, scraping or similar data gathering or extraction methods; and except as otherwise explicitly provided herein, you have no license or intellectual property rights in any of our Website content. You may not use any Nutritionally Sound™, LLC or Harmony with food™, or any logo on www.harmonywithfood.com® or Meg-Orourke.com or other proprietary graphic or trademark as part of the link without express written permission. This limited license is revocable at any time without notice and with or without cause.

Account Security Communications

You agree that all communications that we provide to you electronically will satisfy any legal requirement that such communications be in writing. In addition, we may deliver communications (including legal notices) to you at the street address provided in your membership account. Finally, we may deliver communications to you by any means set forth in any other policy or notice published on the Website.

Property Rights in Site Content

Termination

We reserve the right to terminate your account and access to the Service for any reason, including if we in our sole discretion consider your use to be unacceptable. We may provide you a warning prior to termination, but we are not obligated to do so.

We want you to understand what information we gather from you, how this information is used and protected, and what choices you have about how your information is used. People may see when you join an Open or Closed group, or that you're a member of that group, such as in news feed or search.
When someone adds you to an Open or Closed group, others may see that you've been invited (ex: in news feed or search). Once you visit a group you're invited to, you'll become a member and other people may see you joined.
Only members of the group can see posts. However, anyone can see who joined the group. Therefore, if you do not want others to know you joined Harmony With Food™. DO NOT JOIN THE GROUP

Free Groups – You have the right to unsubscribe at any time.

Paying Groups- Nutritionally Sound™, LLC. Will not reimburse you. What is on the website and the terms and conditions is what we promised. Please read these terms and conditions carefully. You have the option of “unsubscribing” at any time using the unsubscribe button. However, that does in any way mean you will be reimbursed.

Upgrade membership of the Harmony with food™ website: By Signing up via email subscription You agree to receive videos, snack lists, and any other nutrition information that harmony with food provides.

No videos or other information can be shared with friends or on any social media platform.

In the event that you join any group Nutritionally Sound,™ LLC. DBA: Harmony With Food

is no longer in business, the owner Meg Marie ORourke decides to sell the business becomes ill or any

other catastrophic event(s) occur, your membership will automatically terminate.
